In any case that a settlement offer is made, it is usually made with the intention of reducing the financial compensation the defendant might have to pay. The stronger the evidence of the defendant’s fault in your case, or the longer your case continues to drag, the more likely it is that the defendant will make a settlement offer.Defendants want to settle cases with strong evidence against them because they know that if the case proceeds to trial, they could be found responsible for paying hundreds of thousands of dollars (or maybe even more). They would prefer to settle the case for an amount less than the potential compensation amount that might be awarded.
Defendants also tend to want to settle cases that have been pending for a long period of time. The longer a case remains pending and unresolved, the more money the defendant has to spend in legal fees and other costs. At some point the defendant may conclude that it would be cheaper in the long run to settle the case rather than continuing to pay legal fees and other costs.
If you receive a settlement offer, it is important to thoroughly discuss the matter with your attorney. The settlement offer may contain terms and conditions that result in you waiving important rights to pursue additional compensation.
How Do I Know if I Don’t Have a Good Atlanta Car Accident Case?
Do not determine that your case is “unwinnable” or “lost” without first consulting with an experienced attorney.
